Terms of Use
This is an English translation provided for convenience. If there is any difference between this translation and the Japanese original, the Japanese version prevails.
These Terms of Use (the "Terms") set out the conditions for using the iPhone and iPad app "Livenue" (the "App") provided by STONEHASH SOLUTION (the "Developer"). By downloading or using the App, you are deemed to have agreed to these Terms.
1. Scope
These Terms apply to all relationships between the Developer and users concerning the use of the App. Downloading the App and making in-app purchases are also subject to Apple's Media Services Terms and Conditions and the Apple Standard License Agreement (EULA).
2. License
The Developer grants you a non-exclusive, non-transferable right to use the App for personal purposes. No rights in the App are transferred to you.
3. Audio You Import
- You may import and play in the App only audio to which you hold legitimate rights (purchased songs, songs ripped from CDs, your own recordings, audio whose rights holder permits its use, and so on).
- The App's audio processing is for the playback experience on your own device. Please use it within the scope of private use under copyright law.
- Acts that infringe the rights of third parties, such as using illegally uploaded audio, are prohibited. The Developer is not responsible for problems arising from such acts.
4. Prohibited Acts
You must not:
- Copy, modify, reverse engineer, decompile, or disassemble the App
- Redistribute, sell, or lend the App or any part of it
- Interfere with the provision or operation of the App
- Violate laws or public order and morals
5. In-App Purchases and Refunds
- "Livenue Pro" is a one-time in-app purchase. It is not a subscription (recurring charge). Payment is made through Apple.
- With the same Apple Account, you can restore your purchase after changing devices with "Restore Purchases" in the App.
- Refunds are processed under Apple's policies. The Developer cannot process refunds directly. To request a refund, please use Apple's Report a Problem.
6. Disclaimer
- The App is provided as is. The Developer does not warrant that the App will be free of defects or interruptions, or that it is fit for a particular purpose.
- How audio effects such as the live-venue feel are perceived varies with the playback environment (earphones, headphones, speakers, and audio quality) and between individuals.
- Listening at high volume for long periods may affect your hearing. Please listen at an appropriate volume.
- The Developer is not liable for any damage you incur from using or being unable to use the App, except in cases of the Developer's intent or gross negligence. This does not preclude the application of the Consumer Contract Act or other mandatory laws.
7. Intellectual Property
Copyrights, trademarks, and other intellectual property rights in the App and the Site belong to the Developer or to third parties with legitimate rights. Rights in audio you import belong to their respective rights holders.
8. Changes to or Termination of the Service
The Developer may change the content of the App, or suspend or end its provision, without prior notice to users. Any damage you incur as a result is subject to Section 6.
9. Changes to the Terms
The Developer may change these Terms as necessary. We will announce important changes on this page or by other means. If you continue to use the App after a change, you are deemed to have agreed to the changed Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute between the Developer and a user concerning the App shall be subject to the exclusive jurisdiction of the court with jurisdiction over the Developer's location as the court of first instance.
